This Remedial Order follows two prior inspections, one in August 7, 2023, which found:
- During the review of documentation for a custodial death which occurred September 30, 2021, only the August 2021 Medication Administration Record was provided, even though the inmate had been prescribed medications since July 14, 2021. During hte review of documentation of a custodial death which occurred November 26, 2022, medication was started for the inmate, but there is no documentation of who prescribed it.
- During the review of documentation for a custodial death which occurred September 30, 2021, it was determined the Continuity of Care Query (CCQ) was run almost 9 hours after intake. During the review of documentation for a custodial death which occurred on May 10, 2023, it was determined the Continuity of Care Query (CCQ) was run almost 48 hours after intake.
- During the review of video for a custodial death which occurred September 20, 2021, it was determined that two (2) observation rounds exceeded 60 minutes. During the review of video for a custodial death which occurred November 26, 2022, it was determined that multiple round exceeded 30 minutes.
- During the review of video for the custodial death which occurred May 10, 2023, it was determined that multiple round exceeded 30 minutes.
In January 3, 2024, the jail was, again, non-compliant:
- During the investigation of complaint 35173, it was discovered that the Liberty County Jail had housed three (3) inmate in one single cell.
- During the investigation of complaint 35173, it was discovered that the Liberty County Jail had housed inmates in holding cells for more than 48 hours.
- During the investigation of complaint 35173, it was discovered that the Liberty County Jail had housed inmates classified a minimum custody with inmates classified as maximum custody.
Update on Feb 06, 2025:
The TX Commission on Jail Standards announced at their quarterly meeting that the OAG has been asked to file an injunction against Liberty County to force compliance.
